The department of contract obligations monitoring of the Ministry of Economy and Sustainable Development of Georgia was formed on January 12, 2009; The department monitors the execution of the obligations for privatization of Government properties or their temporary transmission and other processes; the department makes sure that all the obligations between the sides are performed on time and the investments are implemented on time etc.
Currently the department is working on the letters that have been brought in by civilian or juridical persons; the department has prepared and sent out 112 letters.
The department registers and systemizes the contracts concerning the privatization and temporary transmission of the government properties (agricultural and non-agricultural lands with the edifices attached to them) by the Ministry.
Tasks and the realms of the Department of Monitoring
- Registration of the contracts concerning the privatization or temporary transmissions of the government properties and the monitoring of the contractors’ obligations.
- The inspection of transmitted properties and making corresponding conclusions while the outworker is under contract; penalizing the violators of the terms of the contracts according to the instituted laws. Violation of the terms may result in nullifying the contract.
- Reports about the upcoming events based on the analysis of contract obligation statuses and the law in force.
- Preparation of corresponding conclusions verifying that the contractor had met all the requirements of the contract, in order for the contractor to receive the absolute right on the property.
Plenary Powers of the Department
- Has the right to request all the necessary information from the contractors and the government or the self-government institutions based on the legislation. Executes other actions that do not counter the law in force.
- Has the right to request information from the territorial organs of the government about their own activities and the contractors’ activities based on the conditions of the contracts and provided results of the monitoring.
